Scope of Application
These General Terms of service (Tos) apply to all deliveries from Jayu to consumers. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside his trade, business, or profession.
Contracting Party
The purchase contract is concluded with Sophie Chen, Stauffenbergallee 8, 56410, Montabaur, Germany.
Conclusion of Contract
The presentation of products in the online shop is not a legally binding offer, but an invitation to order. By clicking the [Buy/Order Now] button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.
Right of Withdrawal
If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions. If you, as a consumer, exercise your right of withdrawal, you shall bear the regular costs of returning the goods. Otherwise, the regulations that are detailed in the following apply to the right of withdrawal.
Prices and Shipping Costs
The prices stated on the product pages include the statutory value-added tax and other price components excluding shipping costs. Any shipping costs will be calculated and added at the end of the ordering process based on the destination region.
Pre-order Information
All products marked with "Preorder" or "Pre-Order" on the product page are binding pre-orders. It is not a non-binding expression of interest. The delivery time for pre-order products depends on the manufacturing time and shipping method to Jayu and cannot be precisely determined by Jayu. In most cases, the delivery time is estimated to be 8-12 weeks. This estimate is only approximate and non-binding. Products marked with "Preorder" or "Pre-Order" on the product page do not depict the final product and may be subject to minor changes. An order that includes both items in stock and products on pre-order will only be shipped once all products of the order have arrived at Jayu's warehouse. Jayu cannot split an order into separate shipments upon customer request.
Delivery
Delivery is only within Germany with DHL. The delivery time for products in stock is up to 7 days. Any deviations in delivery times are indicated on the respective product page. Products marked with "Preorder" or "Pre-Order" have a longer delivery time, which depends on the manufacturing time and shipping method. Jayu usually estimates the delivery time to be 8-12 weeks. This estimate may vary and is not binding. If an order contains products marked with "Preorder" or "Pre-Order" as well as items in stock, the shipment will only be dispatched once all products are available. Splitting the shipment into multiple individual shipments is not possible. Jayu recommends placing separate orders for these products in this case.
Payment
Payment can be made by credit card, PayPal, Klarna, ApplePay, GooglePay, or bank transfer.
Retention of Title
Until full payment is made, the goods remain the property of Jayu.
Warranty for Material Defects
Jayu is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 et seq. of the German Civil Code.
Limitation of Liability
As a service provider, we are responsible for our own content on these pages according to § 7 para.1 TMG (German Telemedia Act) and general laws. However, according to §§ 8 to 10 TMG, we are not obligated to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity.
Dispute Resolution
The European Commission provides an online dispute resolution (OS) platform, which can be found at http://ec.europa.eu/consumers/odr. We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.
